Finance is provided, subject to status. To apply you must be at least 18 years old and a UK resident. A guarantor may be required.

Credit is only available on cars supplied by us.

Telephone calls may be monitored or recorded for security and quality control. Information is available in large print, audio and Braille on request; please call for details.

This order and any allowance in respect of a used motor vehicle offered in part exchange by you is subject to acceptance by us, confirmation of which is acknowledged by us within the "Seller's" declaration overleaf

Deposit

Please note that the deposit is paid on the understanding that the vehicle ordered is subject to a firm agreement to purchase and is treated as such and that the part exchange details are exactly as stated overleaf. The deposit will secure the vehicle for 7 days; payments over £500 sterling shall not be made in cash.

Cancellation

If you cancel the order we will treat the contract as cancelled and seek reasonable damages which may be more, less or the same as the deposit placed. If you fail to take and pay for the goods within 14 days of notification that the goods are available for delivery, we may treat the contract as cancelled and seek reasonable damages which may be more, less or the same as the deposit placed. If you cancel the contract because of a price change notified by us to you, any deposit, which you have paid to us, will be returned to you. Should we have to give you notice that we wish to cancel this contract, for example due to the Manufacturer ceasing to produce the goods, we will pay you damages which will usually equal the deposit.

Delivery

We will try to ensure delivery of the goods ("Goods" in these terms and conditions is defined as our sales to you) by the estimated delivery date (if any) but cannot guarantee the delivery date. If the delay is caused by circumstances beyond our control we will contact you and agree an alternative date. If we fail to deliver the goods within a reasonable time of the estimated date of delivery in this contract you may write to us, requesting to make time of the essence requiring delivery of the goods within 7 days. If the goods are not delivered to you within 7 days the contract shall be cancelled. If the contract is cancelled any deposit paid by you shall be returned to you.

Title

The goods shall remain our property until the price has been paid and cleared by our bank in full. A cheque given by you in payment shall not be treated as paid in full until the cheque has been cleared. The proceeds of any goods re-sold by you prior to the cheque having been cleared are to be held by you in trust for us. The risk in the goods passes to you when you take delivery.

Payment

We will not accept cash payments over £5000 sterling. We will accept Bank transfers, Bankers drafts, Building society checks and most major debit and credit cards. When paying by credit card a 3% charge is applicable to all payments over £500.Within 7 Days after we tell you that your goods are ready for delivery, you can arrange for a finance company to purchase the goods from us. We will not accept American express.

The goods

The motor vehicle is sold as roadworthy, or subject to any defects notified by us to you and accepted by you at the date of delivery. If any fault occurs you have the right to rely on your legal rights. Any accessories are included in the manufacturers warranty but if you have a problem your legal rights also allow you to ask us to repair, replace, full or partially refund the faulty accessory. In the case of a motor vehicle no allowance can be made for any part of the standard equipment supplied with the motor vehicle, which you do not wish to take. We will for 28 days after delivery pass on to you all items of equipment that we shall receive for the vehicle but the supply of items such as spare keys, book packs, service history, locking wheel nuts, key or radio codes cannot be guaranteed unless detailed on the order form. After this period any further items shall be deemed as unobtainable and the company not liable. The company shall only be liable for supply of any additional items if each item is clearly detailed on the order form.

Warranty

We undertake to ensure that the pre-delivery work specified by the Manufacturer or Importer is carried out and that we will pass on the benefit of any balance of warranty or guarantee given by them to us. These warranties or guarantees are in addition to and not in replacement of any third party (normally RAC or similar) warranties or guarantees given or sold by us. We cannot guarantee the period of such warranty will be the same as would normally be offered by a franchised dealer. No warranty, other than provided by statute is given by P.G.Motors, you can purchase a third party (normally RAC or similar) extended warranty before delivery, please note these cannot be cancelled.

Price changes

If after the date of this order and before delivery of the goods to you, the Manufacturers or Importers recommended price of any goods is changed, we shall give notice of any change to you. If the Manufacturers or Importers recommended price for the goods is increased you will be notified of the amount of the increase we intend to pass on to you. You have the right to cancel the contract within a reasonable time of receipt of this notification.

Part exchange

When we accept a used motor vehicle as part payment you agreed that:

A. You are the legal owner. B. No outstanding credit is owed on the vehicle. If there is an outstanding credit the amount of money, we give you will be reduced by the equivalent of the amount of the outstanding credit. Our acceptance of your offer in relation to the part payment is only valid if your used motor vehicle is delivered in the same condition as when we examined it. You must deliver your used motor vehicle to us on or before the day you collect your goods from us. From the day you deliver it to us we are the legal owners. We will telephone or write to you and tell you that your goods are ready for collection. You must deliver your used motor vehicle to us within 14 days. If you delay the delivery of your goods from the agreed delivery time we may deduct an amount for depreciation of your used motor vehicle. All part exchange vehicles must have a valid V5 document, if a V5 document cannot be produced at the time of delivery then a £500 fee must be paid. This will be refundable on delivery of the V5 document to us, for a period of 28 days from the collection of the goods. All part exchange vehicles are valued to include the road fund licence. If above conditions are not met, we will not accept your used motor vehicle and you will pay the full price of the goods.

Notice

Any correspondence to you will be sent by normal post rather than registered or recorded delivery, to the address you have given overleaf. P.G Motors will use any information collected to inform you about new products and services and to inform you how we serve you. Your data will be treated in accordance with European Legal provisions. Your information will only be disclosed to P.G.Motors and its affiliated or associated companies, Agencies, Dealers or Companies providing services for your benefit. Should either party waive any of their rights under this agreement, it is not agreed that those rights have been waived permanently.
